These Terms of sale (from here onwards simply "general conditions") govern the sale of products marketed by Edonè Wine S.R.L. (from here onwards, for brevity, simply "Edonè") through the website www.edoneprosecco.it (from here Forward "site"). All contracts for the purchase of products concluded through the above-mentioned site will be governed by these general conditions (according to Italian law and in particular to Legislative Decree No. 70/2003 implementation of Directive 2000/31/EC in the field of trade E to D. LGs. 206/2005 with specific reference to the legislation relating to distance contracts).

Any changes or new conditions of sale will be reported promptly to the customer, will be effective from the time of their publication on the site and will be applied to the only sales concluded after the publication.

All published prices of intends VAT included where provided.

Acceptance of the conditions of sale

The contract stipulated between EDONÈ and the customer must be concluded with the acceptance of the order by EDONÈ which, at its sole discretion, reserves the right to accept the order. Acceptance is deemed tacit, unless otherwise communicated in any way to the customer.

By placing an order, in the various modalities envisaged, the customer declares that he has read all the indications provided during the purchase procedure and to accept in full the general conditions transcribed below.

Once the online purchase procedure is completed, the customer will print, or save copy to electronic media, or otherwise retain the following general conditions.

How to buy

The customer can purchase only the products present in the electronic catalogue consulted on the site at the time of the order, as described in the relevant information sheets.

The technical information on the site reproduces faithfully those of goods included in the catalogue. EDONÈ reserves the right to modify the technical information of the products without any prior notice. The photographic representations accompanying the description of a product may not perfectly represent its characteristics, differing in colour, size, and/or accessory products present in the figure.

It is excluded the recognition of contractual and/or non-contractual liability, and with it the right to compensation or compensation, for damages caused to persons and/or things following a non-acceptance of the order, even partial, by EDONÈ;

All purchase support information is to be understood as a simple general informative material.

The correct receipt of the order is confirmed by EDONÈ through a reply by e-mail sent to the e-mail address previously indicated by the customer. This confirmation message will report the date and time of receipt of the order, a ' customer code ' identifying the order to be used for any further communication with EDONÈ and all the data entered by the customer at the time of the order submission. The customer, with reference to the latter, undertakes to verify their correctness and to communicate in a timely manner any corrections with the modalities that will be indicated in this document.

In case of non-acceptance of the order, EDONÈ will promptly inform the customer by e-mail to the e-mail address previously indicated by this.

All the prices on the site are to be understood prices to the public and, therefore, inclusive of VAT. EDONÈ reserves the right to change prices at any time, without notice. If a wrong price is published and/or clearly negligible, for any reason, the order will be cancelled, even in case of initial validation.

The possibility of simultaneous access of multiple users to the site and to execute multiple "on-line" orders at the same time could quickly change the availability of the product; EDONÈ, therefore, does not guarantee the actual availability of the goods ordered as well in the event that it comes, at the time of the order, indicated as "available". EDONÈ, if for these reasons the product does not have to be available, although otherwise indicated at the time of the order, it will promptly inform the customer by e-mail to the e-mail address from this indicated at the time of the order being forwarded.

On certain products, subject to price promotions, EDONÈ reserves the right to accept orders by reducing the quantities, after communication and acceptance by the customer, in defect of which the order must be deemed to be cancelled.

How to pay

The customer can buy the products on the site using the different forms of payment indicated in the purchase process. Any additional costs pertaining to a particular payment method will be explicitly highlighted during the purchase process itself.

Delivery mode

EDONÈ delivers its products through specialised couriers. The products within 48 hours of receipt of the order will come from EDONÈ entrusted to the specialist courier who, depending on the area of destination of the goods, shall deliver within a period of time ranging from 24 to 48, unless due to random impediments Fortuitous or force majeure.

Shipping costs are usually charged to the customer and are expressly indicated at the time of the order.

At the time of receipt of the goods the customer is required to verify the integrity and, if he has doubts about the integrity of the same, must indicate it on the receipt of delivery.

The customer will have 10 working days from the reception to verify the integrity of the goods and to communicate any damages to EDONÈ to the e-mail address info@edoneprosecco.it. EDONÈ will reimburse the customer within 10 working days of the communication.

Right of withdrawal

If the customer is a consumer (i.e. a natural person who buys the goods for purposes extraneous to the entrepreneurial, commercial, craft or professional activity, if any) is entitled to withdraw from the purchase contract for any reason, Without any penalty and without obligation to specify the reasons, within the period of 14 working days from the acquisition of the physical possession of the goods.

To exercise the right of withdrawal the customer must send a written notice to EDONÈ by registered letter with notice of receipt containing clear and expressed willingness to exercise this right, however manifested. The communication may be sent, within the same period, also by telegram, e-mail and fax, provided that it is confirmed by registered letter with notice of receipt within the next forty-eight hours. In the communication you must also indicate the bank details necessary to return the sums paid in addition to the "Customer code" identification of the order made. EDONÈ will send to the customer by e-mail (to the e-mail address indicated by the customer at the time of registration or placing of the order – unless it is expressly made by the customer indicated for this purpose, in the first communication, one A paper form containing the authorization number for the withdrawal that will have to be printed and attached to the outside of the enclosure where the product will be physically placed. The whole must be sent, with shipping costs exclusively payable by the customer and within 14 working days, to the address that will be indicated therein.

The right applies to the product purchased in its entirety not being possible to exercise recess only on part of the product purchased.

The purchased goods must be intact and returned in its original packaging, complete in all its parts (including packaging and eventual documentation).

The shipment, up to the attestation of receipt by EDONÈ, is under the full responsibility of the customer; In the event of damage to the property during transport, the customer will be given timely notice of the incident (within 5 working days of receipt of the goods by EDONÈ),in order to allow him to file a timely complaint against the Courier chosen by him and obtain reimbursement of the value of the asset (if insured); In this case, the product will be made available to the customer, at the same time canceling the request for withdrawal; EDONÈ does not respond in any way for damages, theft or loss of goods returned by uninsured shipments;

Exercised the right of withdrawal, EDONÈ will refund to the customer the full amount already paid, as soon as possible and in any case within 14 days from the date of receipt of the notice of withdrawal, upon receipt of the goods covered by the withdrawal, By means of the transfer of the amount charged to the credit card or by bank transfer. In the latter case, it will be the customer's care to provide promptly the bank details on which to obtain the reimbursement (Cod. ABI-CAB-current account of the invoice holder). The customer will be reimbursed all payments made in favour of EDONÈ, including delivery costs (except for the additional costs arising from his eventual choice of a type of delivery other than the less expensive type of standard delivery offered by us) .

If the goods have suffered a decrease in the value due to a non-diligent use, in the event of a right of withdrawal, the consumer will be held responsible for the lowest value. The costs and risks of transportation for the refund are fully charged to the customer.

In the event of forfeiture of the right of withdrawal EDONÈ will return the purchased goods to the sender, charging the same shipping costs.

Guarantees

All products marketed by EDONÈ are covered by the legal guarantee of conformity under Legislative Decree No. 206/2005. To qualify for warranty assistance, the customer must retain the invoice (or DDT) that he/she will receive together with the goods purchased. The customer can always download the invoices related to his purchases, accessing the specific area of the site reserved.

In the event of a defect of conformity, the consumer is entitled, at his choice, to repair or replace the defective goods by the seller, without charge of expenses in either case, unless the remedy required is objectively impossible or Excessively onerous than the other. If replacement or repair is not possible or excessively onerous, the consumer is entitled to a fair reduction in the price or the termination of the contract.

The legal guarantee of conformity lasts two years after the delivery of the goods and must be relied on by the consumer, on penalty of decay, within two months of the date on which he discovered the defect.

In case of dispute, EDONÈ agrees to:

Take over the defective product to check whether or not the malfunction depends on a defect of conformity.

In particular: (i) for defects occurring in the first six months from the date of delivery of the product, the verification shall always be borne by the seller as they are presumed to exist at the time of delivery; (ii) Thereafter, in the only case where the malfunction does not depend on a defect of conformity, the consumer may be asked to reimburse the cost-reasonable and previously indicated-that the seller has supported for verification;

Having found the defect of conformity, repair or replacement of the goods within a reasonable time of the request and without charge of expenses to the consumer.

Privacy

The personal data requested during the order are collected by EDONÈ and processed on computer media, in order to satisfy the obligations born from the contract concluded with the customer and will not be in any case and no title transferred to third parties. EDONÈ guarantees its customers compliance with the rules regarding the processing of personal data, governed by the Privacy Code of D. Lgs. N. 196/2003. Owner of the data processing is Edonè Wine S.R.L., Via Calnova 60, 30027 S. Donà di Piave (VE),in the person who from time to time has the legal representation, unless it is appointed a manager under the art. 29 of Legislative Decree No. 196/2003. The customer, at any time, is entitled to revoke consent to the processing of personal data by written notice to be sent to the registered office of EDONÈ. To the customer, who claims to have received the information in accordance with art. 13 and on the rights to the same spectators, pursuant to art. 7 of Legislative Decree No. 196/2003, has the right to access its data according to the modalities envisaged therein. Marketing Communications will be sent only with the express consent of the customer issued together with the authorization to the processing and the submission in the online registration form.

Protection of minors

EDONÈ does not sell wine or other alcoholic products to children under the age of 18 under law 8 November 2012 no 189. The courier will not deliver wine or other alcoholic products to children under 18 years of age and may apply for an identity document in order to verify their ages.

Jurisdiction and applicable law

The sales contract between the customer and EDONÈ is understood to be concluded in Italy and regulated by Italian law. For the settlement of civil and criminal disputes arising from the conclusion of this distance selling contract, if the customer is a consumer, the territorial jurisdiction is that of the reference hole of his municipality of residence; In all other cases the territorial competence is exclusively that of the Forum of Treviso.
